Live Courses Payment/Refund Policy
Any payments are NON-REFUNDABLE. However, any seminar that is cancelled due to our responsibility will be refunded 100% of all monies paid.
If you cancel/or change your registration before 30 days to the start date of any workshop, you may request a onetime roll over consideration for a future class at no charge. If you cancel/or change your registration between 30 days to 15 days before the start date of your registered class, you may request a onetime roll over consideration to a future class for a $80.00 roll over fee. If you cancel/or change your registration between 14 days to 1 day before the start date of your registered class, you may request a onetime roll over consideration to a future class for a $150.00 roll over fee. Students must attend entire two-day workshop in order to receive continuing education hour credits. There are no partial continuing education hours offered for courses - no exceptions.
For those traveling from out of town please be aware that we will not reimburse for non-changeable, non-refundable airlines tickets. If there is not enough interest to fill a particular class, the instructor reserves the right to negotiate terms privately with the individual but will not be held responsible to pay for a ticket should you purchase a non-refundable or non-changeable ticket.
If a class is cancelled due to weather the course will be rescheduled to a new date. This date will be determined by choosing a date that works for the students and instructor. If a date is chosen that doesn't work for a student, that student can be refunded their money.
eLearning Programs Payment/Refund Policy
Any and all payments are NON-REFUNDABLE. Students receive downloadable manuals that cannot be returned. If you purchase a Barefoot Trainer's Ashiatsu® eLearning Program with a monthly payment option you are in agreement that if any payment is missed to contact and/or respond to email or phone contact by Justin Michaud (owner of Barefoot Trainer’s Ashiatsu®) within 24-48 hours of missed payment to discuss the reason for your missed payment. If payment was missed due to personal lack of funds, you agree to make smaller monthly payments, decided and agreed upon by Justin Michaud and yourself, that you can make monthly until total amount due, plus an additional $50, is paid in full. You agree that the new monthly payment will be no less than $5.00 per month. If a new monthly payment plan cannot be agreed upon between Justin Michaud and yourself, you agree that any legal dispute arising out of this agreement/contract will be subject to personal jurisdiction and venue in the state of Massachusetts.
Individual Use
By purchasing/signing-up for any program you are in agreement with Barefoot Trainer's Ashiatsu® & Justin Michaud that this course and its materials are strictly for your individual use only. You agree to not share or allow website access to any other individuals using your login information. You are in agreement that sharing or allowing website access to any other individuals with your login information is punishable for no less than $10,000.00.

By purchasing/signing-up for this course you are in agreement with Barefoot Trainer's Ashiatsu® & Justin Michaud and this agreement is effective as of the date you purchase/sign-up for Barefoot Trainer's Ashiatsu® e-Learning course. All information and materials to be provided you, both video and written, or otherwise shared with you, are confidential and proprietary property of Barefoot Trainer's Ashiatsu® & Justin Michaud. Dissemination of Barefoot Trainer's Ashiatsu® & Justin Michaud's proprietary information provided to you is conditioned upon your acceptance and agreement to be bound by this agreement and specifically to be bound by the following restrictions and obligations:
• You agree that to conduct any derivative or adaptation of Barefoot Trainer's Ashiatsu® & Justin Michaud's courses, programs, or protocols re-created or adapted from Barefoot Trainer's Ashiatsu® & Justin Michaud's information given to you constitutes a material breach of this agreement.
• You agree that you will not teach, instruct, demonstrate, hold seminars or otherwise use or disclose any of Barefoot Trainer's Ashiatsu® & Justin Michaud's information that you have received during any of the seminars taught by Barefoot Trainer's Ashiatsu® & Justin Michaud without the express prior written permission of Barefoot Trainer's Ashiatsu® & Justin Michaud.
• You agree that you will honor the obligations and restrictions set forth above. You understand that any violation of the restrictions set forth above constitutes a material breach of this agreement for which you will be liable to pay damages to the company. You agree that, in the event that a legal action is commenced for breach of this agreement, you will be responsible for all Barefoot Trainer's Ashiatsu® & Justin Michaud's attorney fees incurred.
Barefoot Trainer's Ashiatsu® & Justin Michaud agrees, in consideration of receipt of a fee and your agreement to be bound by the above obligations and restrictions, to disclose to you the protocols, sequences, techniques and materials for which you have paid your purchase/sign-up fee. In any dispute arising out of this contract you agree to be subject to personal jurisdiction and venue in Massachusetts.
Liability Waiver Release
In consideration of the risk of injury while participating in Barefoot Trainer’s Ashiatsu Bar Online Program (the "activity"), and as consideration for the right to participate in the activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the activity, and do hereby release and forever discharge Barefoot Trainer's Ashiatsu, located at 7 Spring Pond Rd., Peabody, MA 01960, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned activity, including traveling to and from an event related to this activity.
I am voluntarily participating in the aforementioned activity and I am participating in the activity entirely at my own risk. I am aware of the risks associated with participating in this activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others negligence, or the condition of the activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this activity.
I agree to indemnify and hold harmless Barefoot Trainer's Ashiatsu against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if a litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Barefoot Trainer's Ashiatsu incurs any of these types of expenses, I agree to reimburse Barefoot Trainer's Ashiatsu.
I acknowledge that Barefoot Trainer's Ashiatsu and their directors, officers, volunteers, representatives and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Barefoot Trainer's Ashiatsu.
I acknowledge that this activity may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, and actions of others, including but not limited to, participants and/or producers of the event.
I acknowledge that I have carefully read this "WAIVER AND RELEASE" and fully understand that it is a release of liability. I expressly agree to release and discharge Barefoot Trainer's Ashiatsu and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, Representatives, predecessors, successors and assigns, from any and all claims or causes of action and I agree to voluntarily give up and waive any rights that I otherwise have to bring a legal action against Barefoot Trainer's Ashiatsu for personal injury or property damage.
To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Barefoot Trainer's Ashiatsu, it's agents, and employees.
In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
In the event that any damage to equipment or facilities occurs as a result of my willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
This agreement was entered into without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the participant, and Barefoot Trainer's Ashiatsu that this agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If the court should find that any provision of this agreement to be invalid or unenforceable, then said provision shall be deemed to be written, construed and enforced as so limited.
